Terms and conditions

These terms govern the sale of goods through this website. They sit alongside your statutory rights, which they do not affect. They are written to be read, so they are short; the returns, shipping and authenticity guarantee pages form part of them.

Who you are buying from

Xanadu Antiques is run by James Treacher. Please use the contact page for questions about an object, an order or these terms.

How a sale is made

Pieces marked with a price and an “add to basket” button can be bought directly through the site. You can also enquire about any piece before buying and discuss a purchase by email; the same terms apply. In either case the contract is formed when I confirm your order by email, not when you place it, and any piece may be withdrawn from sale before that point — for example if it has sold in person the same day. Every object is unique and is sold once.

Description and attribution

Every object is described as accurately as I am able. The attribution stated on a product page — culture, period, reign, ware, and whether a mark is of the period — forms a term of the contract under section 11 of the Consumer Rights Act 2015. Where an attribution is uncertain, the listing says so in those words. The authenticity guarantee sets out the remedy if an attribution is shown to be wrong, and it has no time limit.

Condition

Every listing carries a condition grade and an itemised list of faults. Age-appropriate wear consistent with the stated period is not treated as a fault. Faults drawn to your attention before purchase are excluded from the satisfactory quality term by section 9(4) of the Consumer Rights Act 2015. A full condition report is available on request before you buy.

Price and payment

Prices are in pounds sterling and do not include import duty or local taxes outside the United Kingdom. Available payment methods are shown at checkout or agreed with you before an order is confirmed. A piece is dispatched, or released for collection, once payment has cleared.

Delivery and risk

Pieces are packed and insured as described on the shipping page. The goods remain at my risk until they come into your physical possession, or that of a person you have identified to take delivery, as section 29 of the Consumer Rights Act 2015 provides. If a piece arrives damaged, contact me as soon as possible and the insurance claim is mine to make.

Cancellation and returns

You have 14 days from delivery to cancel, on every piece, for any reason. See Returns and cancellation for the full terms, including how to cancel, how to pack a return and when the refund is made.

Authenticity

Every piece is covered by the authenticity guarantee, which has no time limit.

Something wrong?

Tell me first, through the contact page. Most things are resolved in one email. Nothing in these terms limits your right to take a complaint further.

Governing law

These terms are governed by the law of England and Wales.
